What if we choose to change the direction of this thread--or start a new thread (better idea?)--where we discuss the daily machinations of the coming state and federal trials, each of which comprises crimes never tried before?

Are we interested in starting a new thread to discuss these ongoing, historic trials? If so, I'm happy to start that thread and link to it from here. How about a simple page in Off Topics called The Trials of 2023?

The heat went up a degree.

According to section 3 of the 14th amendment Donny is disqualified from holding office in the future.

For this to be accurate he would first need to be convicted of participating in an insurrection/rebellion. Not even sure he’s been charged with anything of the sort. (There are so many charges…)

If candidates for office can be summarily disqualified by any politically motivated state AG, we have a serious issue. Like constitutional crisis level issue. What would we do if only red states had Trump on the ballot and only blue states had Biden? The system fails.

He was found guilty of inciting and supporting an insurrection during his 2nd impeachment. He just wasn't punished for the crime.

On the other hand, my fear is that the position or title of "President" is not specifically mentioned in the Amendment.

Just saw this, neither here nor there…. but credit where it’s due: he’s following the law as it currently stands in AZ, despite his party affiliation.

One problem with all of this is, even when found guilty of insurrection under the 14th amendment, enforcement of it lies solely with Congress, per the Enforcement Acts. If Congress does not take action against him; it is all mute.
 
Like I said, I would expect at least a conviction on the charge of insurrection to be judged to have participated in one. Gotta be careful when playing these games. What if Repubs solidify power someday and decide that there is ample proof that Biden took money/bribes from the Chinese in exchange for influence? Is that providing aid to an enemy, tantamount to insurrection? Slippery slope.

Who the hell gets to define what an insurrection is? Lots of people would say Biden is subverting our national interests by “disappearing” our southern border. Can we jail him for life now? How about just DQ’ing him from the next election? I don’t think so.

Trump directly incited the attack on the Capital. The whole thing happened because of him and his instructions to the crowd to 'stop the steal'. You don't consider that participating materially in what happened? Trump is directly responsible for all the damage and at least one, possibly three, deaths resulting from that day's shameful events. And what the hell does Biden or his dealings have to do with it? Sure, if Biden is guilty of something, he should answer for it. That has nothing to do with Trump finally having to answer for his multiple crimes.
