Work in the Right-of-Way Permits

Just wondering if you guys have to obtain a "Work in the Right-of-Way" permit for every job you do? The way our city ordinance is... any contractor has to get a permit if they are in the street, curb, gutter, sidewalk, or alley.

There are obvious concerns that should require a permit. For example, blocking a lane of traffic, shutting down a street, working in an alley, can all be understandable.

But, it's the rule that if you are simply parked at the curb... you must have a permit.... that bothers me. It's not rational at all.

A permit must be filed in person and signed off. It is a $40 dollar permit.

I got approached by a city guy (for the first time in nearly 9 years of doing business in my town) and he asked me if I had a Work in the Right-of-Way permit. I didn't. And I never get one unless I'm going to block a lane (for a long period of time), a whole street, alley (for a long period of time), etc... Pretty much I get one when it is really necessary.

I looked at my records and I think I did 300 jobs in my town alone. This would have been $12,000 dollars in permits!

Sure customers have to absorb that cost, but for some of the smaller jobs, that $40 dollars could add on nearly 30% more. Why would a customer pay 30% for a small job if the next guy in line won't even think of getting a permit, to charge less?

I could go on and on abou this...

This is sort of a rant... But, does anyone else have do do such a thing?
 
That's why I live in New Hampshire, which is the "Live Free Or Die" State.

No permits necessary in any city or town. Just make sure that you follow USDOT MUTCD for traffic control, or you may be cited.
 
That does sound extreme. Take it to the court clerk or the building inspector or whomever knows who makes these laws. Find out for sure what they want you to do. Although sometimes rules are made to be broke.

It's just a given in New York city if you drive a truck you pay X amount for parking tickets. Big delivery companies, i.e. UPS just fight the thousands or millions they incur in a year to a lesser amount. Then it just eventually get billed to the customer.
 
When I worked in Denver the company talked with the city money grubbers and got a better definition of the fee structure.

If this fee were uniformly enforced every taxi, garbage truck and package delivery vehicle should pay a fee for EVERY stop that they make. that wasn't the intention of the fee structure.

Yep. I agree Tom. It would have to be followed to the "T". And there would have to be some sort of enforcement about this too.

Anyone else have to pay a fee and get a Work in the Right-of-Way permit to work in front of a customer's home?
 
Only if we plan to shut down a whole street. It is mostly to notify Emergency Services (i.e. ambulances, fire trucks) that the route is blocked.
I must turn in paperwork @ Police station and pay $25 fee.
I have only done it once in ten years... mostly we wing it with official looking cones and detour signs...

Nice. I'm sort of thinking I'll do the same in the non-arterial streets.
