Why don't you do what the gun modification part makers do?
Sell parts for self assembly or in a kit.
Nothing stops you from selling webbing bolted to an ascender or attachable by end user.
Tubing, bungee, and foot loop sold separately.
This would limit your liability and running foul of any patent.

I own and climb on your SAKA and wouldn't want to be stuck without access to replacement parts.
I prefer the your design over the other.

I wish it was that simple.

Shoot, sorry to read this. I bought a SAKA and first gen Haas, still use the SAKA almost every time I climb a tree.
