On Thursday, March 20, 2014 the ASM Board met with Attorney Michael Hale to discuss the next steps for its members.
The ASM Board recommends the following important steps:
1. Contact ASM and let us know that you have been impacted. As a membership association, it is very important that ASM know how many of its members have been affected. We are here to help and guide you, just like a 'watchdog service'. We want your business to stay open and thrive. The more people we know are affected, the bigger our "voice" is with legal action. Your membership dues pay for this contact, this communication, this support, this service!
ASM is committed to doing research to find other solutions for your insurance needs. In doing so, we need your help. If you are an ASM tree care company, you should have received a survey request via email – please connect and respond to a short 10 question survey by March 28, 2014. Answering these questions will give the ASM Board important information to aid in finding quality, valuable solutions to your future insurance needs. Any personal information will be kept confidential.
2. Call the Insurance Commission - 877-999-6442, ask for Jason McNally. He will provide you with contact information for your insurance carrier(s) and answer any questions on how to file a complaint.
It is important to maintain your coverage - Contact your insurance carriers (Travelers, West Co, etc.) and communicate about what is going on. Be aggressive in your discussions in order to maintain coverage, which will buy some time while the legal process moves forward. Contact us if you want a list of agents in your area.
3. Pursue Legal Action - Attorney Michael Hale is available for consult and for hire to help get your money back. Mr. Hale is offering a discount to all ASM members for legal service. Call or email him for more information. Michael S. Hale, J.D., CPCU, AAI - Attorney specializing in insurance matters, 248-321-8941, mhale@hale-lawfirm.com, www.hale-lawfirm.com,
4. Audit Process - There will be audits as a result of this insurance situation. Mr. Hale is also willing to help with the process.
In closing, the ASM Board is actively monitoring this situation. Please know that we are communicating the issue as aggressively, quickly and judiciously as we possibly can. If you know of a tree care company that may not be a member, please reach out to them and tell them to call ASM. We want to be able to help them too. If you have questions, please feel to touch base with ASM, Executive Director, Annie Kruise, CMP, at 517-337-4999 or via email at asm@acd.net.
