attorney threatens to sue me

If a lawyer has time to sue you for a Pecan tree , he has nothing else going on . House poor , with nothing better to do than mess with a glorified landscaper. House poor lawyer ; 1 , Glorified Landscaper ; 0

I think if you give a price you stick to it no matter what . Thats your job? You should know what your looking at.Otherwise you could under bid every job just to rise the price later.

Wow! I had a run in (did tree service for)with a lawyer a while ago. His ego wasn't nearly as close as your customer's.

Long story short: At the end of the first day of a 2 day long job, I told him I made a mistake and underbid myself. I simply did not know how much dead wood was in his, 4, never been pruned, Ash trees. I needed $300 dollars extra to finish. I explained my mistake and he concurred to for me to finish at the increase price.

(BTW. I have only approached a customer a hand full of times in a situation like this. I usually just suck up the loss and move on)

Anyway, he tried to coerce me to pay him back! About one week after the job I got a threatening e-mail from him. He demanded a time frame of when I was to pay him back.

I scheduled a time to go over to his home to talk to him. I placed my PDA in my coat pocket and recorded our conversation. I was quite comical. He was getting all worked up, but in the end he finally realized that he agreed to pay me the extra amount to finish the job.

He had nothing on me and he knew it from the beginning.

Mechanics always increase their prices when they find that they are getting into more work than necessary. They will communicate to the customer first before proceeding. So, I thought I would try the same.

Man, if I could predict the future, I'd be in a different line of business!

Changing the price after you start is just as bad as a customer saying they won't pay as much since you did it quicker than they thought it should take, or do you knock money off a quote if it is easier than you thought.

Lawyers do not have to give firm quotes on most of their services; why should we be held to an inaccurate estimate?

[/ QUOTE ]

Neither do mechanics.

And we shouldn't expect them to either. Because they may see more work to be done as they go along.

As with my experience.

Have you ever under bid yourself? If not, then you can predict the future.

Like I said, I haven't had the need to do that much out of the hundreds (literally) of jobs I have done.

Besides, it is written as an "ESTIMATE".

One could do that. (If they were dishonest) But, common mang! I have more integrity than that. Remember, I'm Not-A-Hacker!

You're right, it can go both ways. And I have given back hundreds of dollars to customers. Do I do it all the time? Nope! But, I will favor elderly, widows, single moms, etc...

How about you Wade? Have you ever given back?

Blowing it on a bid is one thing Wade, Finding something unexpected is another.

[/ QUOTE ]

Thanks Jim. I'm glad to see some one understands.

Again, "If I could predict the future, I would be in a different line of business."

[ QUOTE ]
I dont uderstand? What was unexpected.

[/ QUOTE ]

Basically, I said there was a lot more dead wood in the trees than I could see from the ground.--That was unexpected.

Yeah, I made a mistake with my estimate. So, I clarified it with the customer half way through. He agreed to pay more.

My point was just that if you or I make a mistake we should stick to the bid. Thats why they call you. Not a fly buy night tree cuter.I stick to my price..

Volunteer with kids? Or, giving money back to the Boys & Girls Club on a estimate you accidentally bid too high?
