99% of the time when push comes to shove, these guys fold like a house of cards. Don't let him get to ya, he sounds like he's not worth it.
 
I would have another certified arborist come out and take a look at it. Even if its a competitor, that way you have a second opinion. Have him document everthing. You document everything, take tons of pictures. File the work that you have done on the tree (dead branch) maybe even go to extremes of taking pictures of the lead you tied into, what course was taken through the tree when the work was done. Keep it on record incase he ever (probably not) legal action. Can't go wrong with to much info.

Sorry to hear all that. Sucks. Don't give in to his wishes though. I can't stand when people like that "win" or get what they want
 
Whatever you do, don't give into his demands. If you do he'll be telling everybody he knows how he scamed you.

Just get all the paperwork you can to cover your butt, get a written statment from who removed the dead limb, an arborist's report, pictures, etc.

Yes that is correct, I understand it is not the direct customer, but every person out there is a indirect customer, or potential customer.

And the principle is still valid. To this guy's perspective, he is right.

If you meet with the fella face to face make a big production out of taking exacting notes. Have him stop and repeat what he said and write it down. Let him know that you're serious about what happened and want to have things exact.

record it on video! State time involved in dealing with this situation on the video, as well as additional cost, so that he gets the idea that you are serious about the situation and how you will plan to counter-sue based on a ridiculous nature of the case. State in front of him on the video that you bill yourself at $125/ hour. Video the trees and properties. Explain to him that you will be able to provide expert witnesses, the cost for which will be in your countersuit, etc. Squash him for trying to screw you. While you may not have any of these options legally, it should take him aback and shut him up.
 
How do we deal with difficult people...not that i am an expert nor is this legal advise ( attach here general disclaimer so i wont get sued as well ). Its an era of litigation where taking responsibility and common sense can be over ridden by blaming someone else and making them pay. So be carefull and I'd do as Tom D an South Sound trees said document everything.Try to detach emotionally even when he dissed some one you love.
Just do your best to sort it out as quickly and amicably as possible.

John B.'s anecdotal court case probably happened up north somewhere. Surely a Texas court wouldn't support a claim like the one described. Jimmy, listen to EZ. Just ignore the guy and play it cool. Document that which you are involved with, but don't go out of your way to protect yourself against all scenarios. That's impossible anyway. What an a$$. We had a similar one this past week. They're just rotten people.

PS Have you tried hugging the guy?
 
Hey Jimmy, Happy Birthday! Sorry to have to do that is THIS thread.

If it were me I would probably look up all your records for the work done on your clients tree, as well as the who,what when, where and why you worked on the complainants tree.

You never mentioned the species of tree that had the limb drop. By your explanation of the climb on the neighbours tree, I am assuming it was a codominat trunk tree.

What I meant by professional in my previous post was Assembling the records for the work done (including how it was paid for), species of tree, work performed (and why).... right down to the calls for the ticked off tree owner.

Getting all this done prior to some process server showing up, will get you ahead of the game, and the stresses involved in this type of thing.

It is probably wise to let the tree owner make the next move, as he has to prove YOU did something wrong! You don't have to prove your innocent. BUT I am NOT a lawyer, or even an American.

I do think a good defense is a good offense. There are thousands of reasons for trees and limbs to fail, it is up to the complainant to show why it failed.
