Work contract/agreement

I searched the forum for anything about the topic but came up with nothing. What do you guys use for a work contract? Did you have someone write of up for you? Did you use a template? I need one but would rather not do it myself because I know I'll miss something.

That's funny you ask this I am just about finished with mine. I hired a lawyer to write mine and it was worth every penny. I used a form that my buddy used with with his tree service. I have then sign it every time before I go to work.
 
Well. That's a fuzzy area. I'm an employee according to the boss but I'm cash. No payroll. There lies the gray area when I get hurt. The two times I have used my own insurance and actually got docked hours when I was at the dr getting stitches. Pretty much bs imho but.. Then if I screw up really bad will he cover me or will I be liable.? It's really fuzzy. I'd almost rather be on payroll but he says he can't afford the payroll tax on my income. Funny how it works because I haven't been paid for several weeks. He's in to me for a large amount.

Your a better guy then me. If I'm climbing for cash..... I get cash at the end of the job. Same with the guys that help me. I hand them cash at the end of every single day.

There would be some saws held hostage if I was in your shoes that is a fact.
 
I am not sure if your talking about a contact in regards to a contract climber, but.... I make all my employees sign an employment contract. Its a law in VT. I have to spell out everything that I am offering, pay, benefits, how many hours they will work. I spell out everything so we are all on the same page. I also put what they will get for a raise if they accomplish certain things. Cdl, pesticide license, etc.

Steve, I have dealt with these greedy owners a lot ,when they say they cant afford it what they are really saying is that it will cut into their fat profit. Your employer sounds like a D bag. In business one of my guidelines is to eliminate gray areas. You sound like a straight shooter. This guy is taking advantage of you.

I never understood that, and still don't. You get what you pay for. Why not pay a little more for the good guys so they stay around. A good production climber/arborist should bring a company anywhere from 288,000 a year to 528,000 or more depending on your market. That is a guy who will show up every day, take crew and equipment out and do the work that is well written on a work order form. A guy like that is gold. Imagine if you had three?

Most chapters hold a "Trees and the Law" class from time to time with presentations given by attorneys specializing in preparing contracts for tree service providers, as well as attorneys who specialize in tort law as it pertains to trees and tree work. The chapter office ought to be able to steer you to someone who can help you draft an understandable and enforceable contract.

I agree Royce climbers make the company. My company is small and I climb everyday and any body that works for me gets paid well and is appreciated. I Believe you get back what you put out which is similar to you get what you pay for. Owners who understand this will always be successful in the long run.

Setting up a LLC is easy. Secretary of state website and fill out a form and pay a fee. At least here in Colorado its that easy. You will need an EIN if you don't already have one. I highly recommend it.
