I live in a cruddy apt complex with a slumlord for an owner. the issue was an old rickety tower and slide, play house with three large holes where there used to be monkey bars and a pole to slide down. all of us tennants with children have asked for it to be replaced and apperently they have been asking for three years now. one child even had fifteen stitches in her face from falling off it. i even offered to fill in the holes with plywood. they declined.
so today my son did a face plant from it and burst his lips and the manager just watched and didnt even inquire if he was ok. i told them it needed to be fixed or it would come down....they werent too interested...SO I GOT OUT THE 346 HUSKY AND CUT THAT THING DOWN.
as i was almost done cutting it up, when the cops came. i flipped this play fort over just as they walked up an i gues it freaked em out because according to the neighbors one snuck up on me while i looked at the other two coming to me. according to the neighbors he was aiming his tazer at my butt...THEY WERE SCARED OF THE MAN WITH THE SAW.
so i wound up hauling the thing off with the help of the neighbors who were all cheering me on and we all dug it up and cleaned the area up.
although i may have to install a new play system later. at least no one else will get hurt on it. would you have done the same thing?
 
Sounds like you done good.

Keep track of the medical expenses and subtract them from the cost of the new unit if they push the issue.

I dont understand that a property owner could have a dangerous childrens play item without taking action. Are they not they liable for damage caused by lack of maitanace or dangerous defects? Here in the netherlands all public play things have to be checked regulary and up to specific construction codes. If not in case an accident the owner is hold responsible for the damage or injuries. They do check (randomly) in the field if those things are correct and documented for regular checks etc. If not you get fined.
