Climbing Innovations, LLC is issued the SAKA patent

We are excited at Climbing Innovations, LLC. to be issued patent No US 10,052,521 B1 for the original SAKA (Self Advancing Knee Ascender) It has been a long 4 years in the process with many thousands of dollars and hundreds and hundreds or hours but time and effort well spent. The SAKA mini (patent pending) is now stealing the show, lighter, more compact and costs much less than anything else on the market, plus, it's totally adjustable to fit any climber. These are exciting times to be climbing and we are grateful to be a part of it.
I'm still bound by the agreement that I won't make or sell the SAKA.

I hope you can eventually start making them again. I made several homemade SAKA's, but none of them are nearly as nice as the ones you were selling.
 
Is that based on an agreement you voluntarily signed to keep it out of court (and/or reduce the contact hours with lawyers)?
 
Evo has a good point. The agreement not to make the SAKA may not be binding on anyone except Richard personally. Depends on how it is worded I suppose, but I find it difficult to believe it would be binding against any subsequent holder of the SAKA patent since that patent did not yet exist at the time the agreement was made. And the fact of the patent's being granted now would also imply that there was actually no infringement anyway. But patents are a tricky thing here Stateside. They carry no enforcement or real weight themselves. The burden of enforcing a patent here is entirely on the holder of the patent, which of course benefits larger organizations with a bigger budget for litigation and in-house legal staff. It is not a level playing field at all.
