I know oaks and beech have a tendancy to hold on to their leaves during dormancy, especially the young trees. I'm gonna guess Quercus, for a guess, not too sure on species though---rubra, or palustris?
Boy! I'm hard pressed for choices--That tree has odd form altogether. Let's try Carpinus (Hornbeam), Only genus I can think of that exhibits marcessence, beside the aforementioned choices. More clues perhaps, buds, scale/bundle scars....
