Prayers for me and my GF

jennifer is better. the only issues right now is she has a tweaked neck muscle and her leg is still recovering from where the car door got smashed. she is walking but she walks in pain so the doctors gave her crutches for now until she is able to put her full weight on her leg. she is seriously soo lucky that thats all she came away with from the crash. the police officer doing the investigation of the accident said she is lucky she isn't dead. it was a T bone crash at a 4 way intersection. the driver who slammed into her side was intoxicated and didn't stop at the stop sign.

the officer asked if i wanted to press charges. idk if i should.
 
idk - just some thoughts ... <u>'drunk' drivers have to be stopped!</u> Pressing charges may ruin the other driver's life ... but it may get a drunk some help ... and it might save another person's life ... however, what a PITA; lawyers, court, missed work, false charges liabilities, etc, etc.

On second thought:
You might inquire why the officer did NOT arrest an intoxicated driver ... seems strange ...
 
no he got arrested for DUI DWI. apart from the state charging him for a dui he asked if i wanted to press additional personal charges on him. i just started getting successful with arboriculture and i dont have the time to miss work for this. jennifer says she doesn't wanna press charges but she does want the guy to get some help.

That's a relief ... he's in the system (wetf that means), maybe he'll get the help he needs ... meanwhile you two can pay exclusive attention to getting your lives back together. So, if I may, prayers for the recovery of all three of you.
 
I'm sorry to hear that Josh. Is she in Hawaii? I remember something about you moving to be with her in a year or so.

I'm hoping you can find financial help with that. It's a lot to bear.
 
About taking the time for court...you are already involved and doing the right thing is never without cost.

Your decisions to participate affect more than just you and as mentioned, if you do not participate and this bozo kills someone you would rightly be haunted by the question of whether you should have been more active in your case.

As for the additional charges consider this.

Without knowing what the cop meant by "pressing charges" my reply may be way off base. If we are talking charges for crimes of a personal nature such as assault then my answer is off base. If it means just piling on for the sake of piling on then my answer might be appropriate.

The question probably should be "do I want to punish the driver in addition to the punishment he can get from the state?" if you do, then press charges, if you don't then don't.

Just keep this in mind, none of us are immune to the consequences of our actions, but we should also show the same mercy that we ourselves have been offered by our Creator. That said, there is nothing wrong with letting the government mete out the appropriate punishment while forgoing your right to inflict further punishment.

At the same time, however, you should seriously consider a civil suit to recover your medical and other expenses. First talk with your insurance company, especially if they have picked up the tab so far.

This is one of those times where talking with an ambulance chasing lawyer may well be the thing to do. However, don't just settle for any lawyer, or for thier terms. you can negotiate how much of the settlement they get. There is no reason for a lawyer to ever get more than 15%- 20% of the proceeds. Adn be sure that that is all the lawyer gets, no retainer, no miscellaneous fees, just a straight percentage.

If your lawyer says no, find another.

Prayers to both.

I can understand not wanting to go after someone just for money but the persons actions should be held accountable. This includes the law and the medical bills incurred due to their actions. There is nothing wrong or immoral with that.
 
More explanation is needed here, the story is making less sense to me. There is no DA in the country that waits two weeks to decide what, if any, charges should be filed, and then at the end of the process they ask the girlfriend's boyfriend how to proceed. That doesn't exist anywhere. Unless you were the one driving, or directly involved in some other way?

Regarding the medical expenses, you're praying for work to cover bills that don't sound like they're yours to pay in the first place? The at-fault driver's insurance should be billed, or else her insurance kicks in for under/non-insured coverage? You and her need a good lawyer in the worst way. Hire an attorney, immediately, if not sooner . . .
