Hey All,
Did anyone else get a chance to attend the "Preventing Law Suits" seminar at TCI this year?
The lawyer was good in bringing up the need for disclaimers on our contracts.
I thought it might be a good idea to start a thread where we can share our disclaimers and other "legalese" stuff.
Keep in mind that you need to have competent legal advise to review anything you might choose to include.
One thing the lawyer mentioned is an indmnity clause regarding ownership of trees.
Here is the clause we use:
I hereby warrant that I am the owner of all trees specified in the attached Proposal/Estimate and/or I have secured all legal permission and right to authorize this work to be performed.
I hereby swear and affirm that I have procured all permits, licenses and/or written permissions as may be required. I further agree to indemnify & defend, and pay for all costs that Hivernant Arborists, it heirs, assigns, officers, owners and employees may incur in the event of any action resulting from disputes of such permits, licenses or permission/approvals or ownership of trees listed herein.
How about cabling dislcaimers, any good ones out there?
