From a liability standpoint, if the property owner didn't have knowledge of that old tank, would their insurance pay for house damages or would they come back on your ins.???? Again, I don't know. Just asking.

That to me is the million dollar question. If it is a old tank that was supposed to be filled in once hooked to public, and therefore no one knew about it who is liable?

A probe (3-4' long rebar?) driven in...might have sounded like a rock, might have sounded hollow???? Seems excessive to do that for every outrigger - until one sinks in, them seems foolish to not test every spot.
 
I really don't. Even consider legality with these things. Too me it just seemed to make sense to offer to pay. We did 2 big oaks and I will be grinding stumps for $6100. I'm guessing as there is going to be an excavator on site as they are digging a foundation for an addition the cost will be under a $1000. I already got a$4200 removal literally next door. It's just a freaking blip, no one got hurt and crane is good. I'll take it

Sounds like it should be very cheap the excavator has to pay to haul the excess dirt out do just put it in the hole...hell he should pay you! Haha
I'd make the home owner atleast pump out the shit slurry...

Come to think of it, that tank is illegal if it has been abandoned. Around these parts, if any upgrade is done the old field and the tank are to be removed! Environment Canada would have something to say about that find!
 
You should definitely NOT be liable for any costs incurred because of that illegally abandoned septic tank. The same applies to abandoned oil tanks the law says they need to be removed! There is no excuse for that! It being there endangered your life and the environment.

We were discussing how we could go about trying to prevent this in the future and came up with an interesting idea, water devining, you know with 2 metal rods. We are going to go back to site and see if it detects the tank. We discussed this as we slaid another 4 trees with the crane

Honestly didn't know that...don't have one but have been on more than one property where they told me there was an old abandon tank. Certainly makes sense!
