crane safety standards?

Hey guys. Doing my second Crane removal ever
This time I have to ride the ball to the top of a tall coco palm. The operator told me its against Osha standards to hoist a climber with a shackle above the ball and lanyard through hook. How can I convince the operator its Osha compliant? What do I need as proof? I'm more then confident to perform the work in a safe manner. All that's standing in the way is weather I can ride the ball or not
 
I am in Maui Hawaii. We recently went through some changes with our Osha. We went from a state run hiosh to the national osha.
 
My understanding is that it must be arguably safer to do so then to climb the tree/palm. Is a lift/bucket an option? Are you just going up to set the sling/choker and then cut it at the base? Otherwise you're gonna be tied to the trunk anyway, so can't you just climb it? Pics?
 
Google OSHA CPL02-01-045 and see if that helps you, you should also get the new ANSI
Z133 standard book and keep with your tree truck for quick field reference. ANSI Z133 is recognized by OSHA since there is no Arboriculture specific OSHA regulations
