What would you do?

We have a lawyer that works in our Department and he and I got into this topic one day. He states that the people that have the view are entitled to that view because they those are the conditions at which came first (depending zoning/ ordinances). If the trees where there first and obstructing the view, people cannot force you to cut them down to create a view. But if you were to plant these trees and the surrounding homeowner then lost there view due to the tree growth then they would have some reason to have the trees altered to maintain the view.

Now is this a law debate? yes

In the end if it were me, and if I was asked to do something that compromised my views than it would depend on how bad I needed the job.

"Is the juice worth the squeeze"

If your ok with it, just make sure that your not held liable for the interpretation of the law should it go against your actions.

Unless I misread, the property owner isn't interested in short trees. He's intentionally trying to plant obstructive trees.

If short species were an option, it wouldn't be a predicament.

No, he does not want short trees. The tree species to be planted is Monterey Cypress, which can get to 60+ feet tall, equally as wide. And, they grow quite fast.

As I said before, his intention is to block views with the trees. The guy is actually quite an a**hole. Cheap as all get out. Drives a Bentley, but wants the lowest of all prices.

I LOVE the dump space, it is the most time saving/money saving part going for me, so its the only reason I am thinking about it. I think there may be some sort of a view ordinance out here, where the planting of new trees that eventually block views can be illegal. If that was the case, I would plant in a second, just so we could come out in another ten or so years to remove!

Look at me, I am being as sleezy as the owner now.

Here is the location of the site on Google earth:

Lat: 37°30'13.10"N
Lon:122°28'35.30"W

I have decided that I am not going to do this job. The money is not an issue, and I think it's the wrong thing to do for the community. To boot, this guy lives 50 miles away. He is doing things that are affecting the locals who live in the area. We will see.... someone else may be doing this planting job.

Hopefully, I get to keep the dump site. See all that open space across the street? I can dump there as well. It would be a shame to loose this.

IMO Right choice.

Oh course someone else will be bought but at least its not you. Never sell yourself short.

Ordinance or not, its not the right thing to do if you know its the wrong thing to do.

Put in your advertisement that you have available wood chips upon request. A lot of folks want chips but don't know where to get them.

Did you check out the web page that I suggested ?

Congratulations on deciding to go with your ethics over greed. Our line of work is not safe if you can't sleep well.

I am with the many others who say find something better to do with your chips than dump them.

MTC, I really think you made the right decision. People like him are best left unassociated with...after all, whoever touches pitch gets dirty. I don't think the moral quandary is about the planting and the view ordinances in this case, I think it is about working in cahoots with someone so openly devious and rapacious.
I don't know if you've looked into this already, or if this would be feasible for you, but the port of SF certainly used to take all the chips they could get. There also used to be free dumping at Fort Funston in the hang-gliding area. SF's schools and communtiy gardens were frequently calling about chips. Good luck finding alternatives.

I did just check that site out. So, he stuffs his mulch in the tubes? I always wondered what they put into those sacks! They are all around this part of the coast too, especially near the nursery fields.

Seems like a very helpful way to use the mulch, only problem for me is I have no where to store the stuff.

This time of year gets especially tricky for dumping, my truck gets stuck anywhere off road when its wet. Only had to pay to offload some chips a few times this year, but man does it suck to have to pay $100 to the landfill only to see the mulch disappear on its own naturally. I am convinced the garbage co. is run by the mafia

You could always be a little devious yourself and plant large species that get some horrible disease, plant them a foot too deep, or put copper wire six inches out from the base and let them go. Then they wont be around for long.

Probably not the best advice, but it's fun and sneaky to think this way sometimes.

I'm sure they always want chips at the Arrillaga Family Farm in Portola Valley. Do you need contact info?

Maybe you could get Big "J" to get interested in the wood chip idea and process it on the farm. He has the space and the resource to get things rolling. It would work well for him and for you.. Just an idea.

i would plant with the insurance of being able to keep a
vista prune in the future
to keep everyone happy
if they want view should have bought the ocean front lot

I'd plant them. It's his land. They own the land, not the view.

Until you've seen the deed then you don't know if they do or don't "own the view".

times infinity, treehumper.

I've worked plenty of jobs where a "Vista Covenant" is part of the land title. Covers structures and vegetation.

Are you kidding me? You can "own" a view? That is something I'll never encounter here in Po-dunk Missouri. I guess now I have to semi-retract my "times 2" answer.
