\'Tree trimmer\' thief will spend 3 years in prison

TROY — One of three Troy area men who Miami County detectives said would go on properties seeking jobs as tree trimmers, then steal items from garages and outbuildings, was sentenced Tuesday, May 26, to three years in prison.
Joshua McGilvary, 29, pleaded no contest earlier this month to one felony count each of burglary and breaking and entering as part of a plea deal with prosecutors, who agreed to recommend the three-year term. He was sentenced in Common Pleas Court by Judge Jeffrey Welbaum.
McGilvary, Michael Fultz, 47, and Ricky T. Smith, 27, were arrested in March as part of sheriff’s detectives’ investigation of close to a dozen break-ins of garages and outbuildings.
Deputies said the three pretended to seek jobs at tree trimmers, then steal items such as golf clubs, tools, chain saws and snowblowers from residents.
“I feel bad for what happened ... I am sorry for what I did,” McGilvary told Welbaum before sentencing.
Fultz also was in court Tuesday, pleading no contest to one felony count each of burglary and breaking and entering. He was found guilty, and will be sentenced July 13. He remains in the county jail.
Smith has pleaded not guilty to three counts of breaking and entering and two counts of burglary. A trial is scheduled for June 23.
