What have you all heard about the new insurance requirements for businesses to employees under the recently passed legislation?

Yesterday's customer asked what that meant to me. Said that some 30 employee business was going to lay off all 30, with some opportunity to be hired back as subs (don't know what kind of business). I haven't been up to date at all on that legislation.

The below comments were made in regards to current standards, before I realized you were referring to the new health ins. bs. This new law smacks of big government control....it sucks. Good thing it doesn't apply to small companies.

IRS rules are rather restrictive...Technically, a sub, even if he is licensed and insured, if he doesn't make his own decisions and hours, could be considered an employee.

I've always doubted that that rule would ever be enforced...at least for our work. But I really don't know.

Of course, paying anyone as a sub, if they aren't legit, and giving them a 1099, can mean a higher liability insurance bill, and sanctions from UC, L&I, and the IRS....

Rules are rules, love em or hate em....
