On the music thing, Gord is right. Speaking as one who has been in the music industry (performer/songwriter) for 25 yrs., there is too much "industry," but it has always been like that.
From the performer aspect, any promo is good promo to a certain extent. But, we do have the perspective that the performance is an artistic creation, and therefore is a copywright-able thing. While there is some concern about footage that is of an off-night and not up to their liking being out there forever, the main thing that is of concern is images/sound that are used, especially concert footage, in a way that can be edited out of context. But, generally as long as the whole is played, with adequate citation, there's usually no beef. Especially with the sweet sound of Stihl in the background. Publicity is publicity, good or bad. Performers generally don't worry about free promotion, especially if it may help them get a gig. I've always held that if it is stricktly for private use, go for it. Hopefully I won't suck that night.
Another concern is because the song IS their artistic creation and is how most of them make a living. If someone uses their music to make money, or downloads it for free (sort of like photos of YOUR treework), it's taking what they created and not compensating them for it. Hince all the Napster issues and court cases. The "industry" hacks are even more anal about it.
However, I still don't see the issue with using it on Youtube et al as background, especially when it's cited. Free promo is free promo.
