The joke I got fired over

Many don't understand this. I had to have a "come to Jesus" meeting with some coworkers about some the things they were videoing at work and posting to Snapchat and Instagram. What one perceives as wacky fun on the job site can easily be interpreted as bad optics for the corporation.

And you better believe they scan forums like this if they catch wind of things an employee or former employee is saying. I know that one from personal experience from nearly 20 years ago.
I was gonna ask them to scan my posts here and on reddit. They would leave you with no doubt that I am vehemently anti-racist.

Lawyers chase dollar signs mostly. They are going to look at the ‘damages’ in a monetary sense. So at this point it’s little more than lost wages.
I agree 100% with Tom, HR isn’t there for any other purpose than to ‘protect’ the company.

Consider calling the AG, theoretically they will act as a mediator, and hopefully in a manner that won’t f-up your case.

 
I know there's the principle of the whole thing, and I'm sure you are taking it personal, and it really is bullshit, but if it was me, I wouldn't waste any energy whatsoever pursuing legal actions. It sounds like a shitty place to work anyway. I would just walk away, with absolute faith and certainty that something better will come along. We have very limited time and energy in this life, and spending those precious resources in spiteful anger and resentment over things in the past can really cripple our ability to move forward. I know that for a fact. Here's to bigger and better things Matias.

While I get this sentiment, part of me thinks there is always a benefit to fighting back, if even just to say, "what you did is bullshit, your reason is bullshit, we both know it, I'm calling you out on it.". It helps to move the needle forward, if even only a tiny bit.

Case in point is the Sandy hook/Infowars battle. All that started cus some jackass said it didn't happen. How long have they been fighting that battle? They could have just tried to ignore it. Not really an apples to apples scenario here, but I think it illustrates the point.

I think I will be satisfied with just letting HR know about his malfeasance. His actions cast a strong shadow of doubt over anytging else he has said, and basically clear my name to certain degree, and frankly I do have enough else on my plate that I don't actually wanna spend a bunch of energy on legal battles that may not do much to materially improve my life. I might not even turn down a job offer for a non customer facing position, installing firewatch cameras in Hawaii.

Thanks y'all. I can't tell you how much everyone's words here mean to me. I have some palms to trim for a neighbor, and I had dates booked already for the pruning focused guy that loves to bring me on to work big spready trees, and now that my schedule opened up he'll have more jobs to bring me on.

As for the PGE work, I am probably not gonna go into that, as the line clearance companies have real big egos, and they think of us lowly residential guys as being somehow less than them. I applied for them as a "journeyman tree climber", and they practically laughed in my face when I told them about the work I've done. They said I would have to apply to start at the bottom of their ladder, and that would mean a big pay cut, taking years before I get back to my current rates. Besides, those guys require their climbers to be on spurs for absolutely every climb, and I'm not about that. I have been preaching quality tree care since I was in the orchards.

I will be fine, and hopefully when my old logger buddy gets to start on the Firesafe Council gig, he will wanna bring me back on for the 6-12 months of that. He gets the more challenging bits of those contracts, like chiselbit, so that's hard work, but fun.

I really mean it when I say that you guys feel like real friends, which is not something I've found so much of around here. I wish I could invite you all over for a BBQ.
If you lived in Ohio I’d hire you because of the joke, and your climbing skills would be an ancillary bonus ;) For sure this is a blessing in disguise.

I’d reflect on what your goal is.
You won’t make much money for the job loss, I’m sure the probationary period contact has some verbiage about letting someone go without cause. Even if it didn’t they can make up whatever they like, and it will be a time suck.
Now holding the coworker accountable and making a stink for their collective shitty behavior is something entirely different.

Regardless good riddance as it doesn’t sound like a fulfilling job at all.
