What is this tree? Is it dead?

Just moved to a new home and I'm tying to identify some trees around the property. Came across this...ideas?

To confirm yellow birch break a small twig and smell it. You should have a wintergreen smell. Black or cherry birch has this same characteristic but it's bark is dark and smooth.
Yellow birch is my vote.
