Stiffed for the first time

verbal agreements become he said she said, most judges want a written contract. and blinky making sure your prices are in the market so she can not argue that you screwed her there is nothing wrong with doing that, i call businesses all the time to get their qoutes for certain jobs, it is a marketing strategy to see if i personally am under bidding myself, or over pricing myself out of the market. yes i agree she agreed to a price and she did not argue the price, but i guarentee she will change her tune in court. so there is nothing wrong with getting your ducks in a row. people who do not pay, always make the vendor out to be the rotten a$$ hole. so if you do your homework 9 times out of ten you can prove your not. i know it sucks but that is the legal system. i have been to court a few times in another business and let me tell you the consumer is always right unless you can prove it.
 
google NACM - national association of credit managers. send her to collections and quit thinking about it. that's what i did - twice in 10 yrs, more out of principle than for the $. you pay a stiff percentage to the collections agency (remembering like 25%), but they will get you your money. many many phone calls and black marks on their credit report later, people start to see they won't get away with refusing payment for services rendered. i hate to do it, but after three letters and a few months in accounts receivable for me it was either walk away or send them to collections. figured they'd earned the harrassment (by polite persistent professionals..).
 
verbal contract was fine - they pretty much asked a few questions over the phone and set to work. as i remember, they just took my word for it that the money was owed to me. sucks when it comes to this, but nice to get paid.
