Is anyone familiar with this accident? I tried to search for it but came up empty.
a man who was killed by a falling tree branch during tree felling activities in Roanoke Rapids, North Carolina. The evidence in the case reveals that two individuals were attempting to cut down a tree in a customer’s front yard. There were three trees in a cluster. The cutters dropped one tree (a tall pine) such that when it fell, it fell between the other two trees (like football uprights). The evidence indicates that contact was made between the falling tree and one or both of the other two trees.
Although a bucket truck was available on site, the cutters did not go up in the bucket to determine whether any branches had broken and were hung up in the two remaining trees. There has been some testimony to suggest that the parties did observe one or more “hangers’ up in the two standing trees prior to the incident that killed the victim.
Some minutes later, the victim was standing beneath the trees, either directing traffic or helping to clean up debris. A very large limb fell from one of the two standing trees and struck the victim, inflicting injuries that resulted in his death.
