Removing Old Incinerator From Tree Roots?

Help! My husband just called the city to remove an antique trash incenerator from our back yard. The problem is a beautiful tree (about 2.5 feet trunk) has grown up around it. I'm worried that this will kill the tree. Any advice? Is there something I can do to help the tree or should I fight having the incenerator removed? I have a photo if anyone would like to see for a better idea.

What is the configuration of the incinerator? Are there flanges or lips that the tree might have grown around?

If the burner is just a cube of metal the tree will have just grown around it and is likely to give up it's grip with a gentle tug upwards. But...if the tug is out then the roots may be damaged.

I say leave it where it is and paint it a pretty color. Put some flower pots or a bird bath on it and plant some ivy around it. Antique landmarks are like old trees - here for years but sometimes gone in an instant.
