DOT violation

We received a violation today on one of our log trucks for not having a cover? Anyone ever heard of this? I can't say I've ever seen a logtruck with a tarp over the logs anywhere?

I’ve been all over the South.

I’ve been in Upstate New York & Vermont.

I’ve Spent time in Northern Ontario, Canada.

All related to the Mills & Plants I’ve never seen or heard such.

Never seen a log truck covered either, and I live right near Weaber Sawmill.

Though I have to admit I always wondered about chunks of bark sloughing off in the wind.

Wonder if it was a new guy? Here in AL/GA they are lucky to have brakes. I followed one a week ago that had no working tail lights and the strobe beacon was so muddy it was useless.
 
@Mark Chisholm did you have anything fly out? I only trap when we have a load of dead cottonwood where there could be a potential of bark flying off. But no, I rarely see it and rarely do it. I think your local DOT might be board.
 
Never seen a log truck with a tarp either. I received a tarp violation years ago while hauling slabs of concrete. State trooper told me a gust of wind could blow them out of the dump bed. Company went to court over it and the state lost the paperwork. Dismissed.
 
There is never a requirement to "tarp" any load is there...isn't it just "secure" the load? For decades and decades adequate straps or chains have done so for logs. Wonder if they thought a tarp would hold the logs down better?

Around here any load going to the land fill needs tarped. Trash/construction containers full of debris are supposed to be tarped. Grass clippings, mulch, etc too. I've seen farm rigs pulled over for not having their silage loads covered (though I still see them do it all the time).

Log trucks though is a new one for me.

Is there a statute or code number that you're being cited on?

I got a citation years ago with a Federal DOT code. A trip to the library...google now...where I found that the citation didn't apply. It was a $350 fine, many years ago. When I was in court I showed the judge the DOT reg and pics on my truck. He rolled his eyes and said, 'Of course this doesn't Apply. Dismissed' The LEO didn't show up for court

The local landfill charges people extra if their load isn't tarped... But technically, no they don't. I have never seen a commercial garbage truck with a tarped load. I think that further illustrates my point the "tarp" isn't the requirement...the "secure load" is. When using an open top trailer with lots of small light weight stuff, a tarp is the only practical thing that is going to do it. But if somebody wanted to build a plywood cover that they put over the load and screw it down, I don't think anybody would argue that is not secured.
 
Bark does sometimes peel off going down the road. Never seen a big piece that was noteworthy. Log trucks roll through downtown in Olympia. Never seen a tarp, ever.
 
@Mark Chisholm Was it one of your can trucks or was it a traditional bunk log truck. I spoke with a law enforcement officer a couple years ago and he said if it was a can it had to be covered. I argued that it would be more likely for something to fall off a bunk style log truck that is not required to be covered.... He said its the way the law is written. Another vague DOT law that no one can understand, and by no means makes any sense.
